Discrimination & Harassment Policy

Jet Delivery is committed to a workplace free from harassment, discrimination, retaliation, and other unprofessional conduct. This policy applies to employees and to non-employees we interact with through work, including applicants, contractors, vendors, customers, and visitors.

Zero Tolerance

Harassment, discrimination, or retaliation is not tolerated and may result in corrective action, up to and including termination of employment or ending a contractor/vendor relationship.

Where This Policy Applies

This policy applies in the workplace and in any work-related setting such as business trips, work-related social events, customer locations, job sites, and communications through phone, email, text, in-app messaging, or any electronic media.

Discrimination and Harassment

Any form of unlawful discrimination or harassment is a violation of this policy and will be treated as a disciplinary matter. This includes harassment related to an individual’s protected characteristics, and also includes harassment based on perception or association.

This policy is broader than the legal definition of harassment. Conduct may violate this policy even if it does not violate the law.

What “Harassment” Includes

Keep in mind that “harassment” can include slurs and any other offensive remarks, jokes, or other verbal, graphic, or physical conduct.

Sexual Harassment

Sexual harassment includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:

  • Submission to such conduct is made (explicitly or implicitly) a term or condition of employment;
  • Submission to or rejection of such conduct is used as the basis for employment decisions; or
  • Such conduct unreasonably interferes with work performance or creates an intimidating, hostile, or offensive work environment.

Examples of Unacceptable Sexual Harassment

  • Visual conduct such as leering, sexual gestures, displaying sexually suggestive objects or pictures, cartoons/posters, or sending sexually explicit text messages or images.
  • Verbal conduct such as sexual advances, propositions, requests, unwanted verbal abuse of a sexual nature, graphic comments about someone’s body, sexually degrading words, or suggestive/obscene letters, notes, or invitations.
  • Physical conduct including assault, unwanted touching, intentionally blocking normal movement, or interfering with work because of sex.
  • Harassing conduct communicated via electronic media of any type.
  • Sexually harassing conduct including abusive comments or acts of hostility toward an individual based on gender or sexual orientation.

Important Notes

Sexual harassment does not need to be motivated by sexual desire to be unlawful or to violate this policy. A single incident may be considered harassment depending on the circumstances, and harassment may exist even if an employee’s productivity has not declined.

Types of Sexual Harassment

  • Hostile Work Environment: Conduct of a sexual nature that unreasonably interferes with or alters work performance, or creates an intimidating, hostile, or offensive working environment.
  • Quid Pro Quo: Offering or demanding employment benefits in exchange for sexual favors, or threatening an employment detriment for refusal to engage in sexual activity.

Conduct That Violates This Policy

While it’s not possible to catalog every example, the following conduct violates this policy and may result in discipline, up to and including termination:

  • Unwelcome requests for sexual favors;
  • Lewd or derogatory comments or jokes;
  • Comments regarding sexual behavior or sexual innuendo;
  • Catcalls or whistles; discussions of another employee’s body;
  • Sexually explicit or suggestive texts, notes, emails, invitations, photographs, cartoons, articles, or other written or pictorial materials of a sexual nature;
  • Repeated requests for dates after being informed the interest is unwelcome;
  • Retaliation for refusing a sexual advance or reporting possible harassment;
  • Offering favors/benefits (promotions, evaluations, shifts, duties, etc.) in exchange for sexual favors;
  • Any unwanted physical touching, assault, or blocking/impeding movements.

This list is not exhaustive.

Other Prohibited Harassment

Jet Delivery also prohibits harassment that insults or shows hostility toward an individual because of the individual’s actual or perceived protected characteristics (including, but not limited to race, religion, color, national origin, ancestry, physical or mental disability, medical condition, genetic information, marital status, sex, gender identity/expression, age, sexual orientation, military/veteran status, or any other characteristic protected by law).

Examples of Other Prohibited Conduct

  • Disparaging or abusive words, phrases, slurs, or negative stereotyping based on a protected characteristic;
  • Threatening, intimidating, or hostile acts related to a protected characteristic;
  • Viewing or communicating written or graphic material in the workplace that insults, stereotypes, or shows hostility toward an individual or group because of a protected characteristic;
  • Display of symbols, slogans, or other items associated with hate or intolerance.

Reporting and Complaint Procedure

Jet Delivery cannot remedy claimed violations unless they are brought to management’s attention. If you experience or witness harassment, discrimination, or retaliation, report it as soon as possible.

  • Report to your supervisor or any member of management.
  • If you are uncomfortable reporting to your supervisor, report to Human Resources or the CEO.
  • Supervisors/managers who become aware of potential violations must report them immediately.

No Retaliation

Retaliation against anyone who reports a concern in good faith, participates in an investigation, or otherwise exercises rights under this policy is prohibited and will result in corrective action.
